By accessing or using AxeCheck ("the Service"), operated by AxeCheck ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

AxeCheck is a web accessibility auditing tool that scans websites for compliance with WCAG 2.1, Section 508, ADA, and EN 301 549 standards. The Service provides automated reports identifying accessibility issues and recommending fixes.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service to scan websites you do not own or have authorization to test.
• Attempt to circumvent usage limits, rate limits, or security measures.
• Use the Service for any illegal purpose or in violation of any applicable laws.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Transmit viruses, malware, or other harmful code through the Service.
• Resell or redistribute the Service without our written consent.

5. Subscriptions and Billing

• Free accounts are subject to usage limits as described on our pricing page.
• Paid subscriptions are billed monthly in advance. Prices are in USD.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days notice to existing subscribers.
• Refunds are handled on a case-by-case basis at our discretion.

6. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by AxeCheck and protected by intellectual property laws. You retain ownership of the websites you scan and the data contained within. We claim no ownership over your content or scan results.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that accessibility audits will identify all issues on your website. AxeCheck reports should be used as guidance and do not constitute legal advice or certification of compliance.

8. Limitation of Liability

To the maximum extent permitted by law, AxeCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless AxeCheck and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Modifications

We may modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
